When choosing a domain name it is important to be aware of any potential trademarks which are in force. If you were to register a domain name with a trademark, the owner of the trademark can be entitled to request this name.

Domain Name Cybersquatting

Cybersquatting is registering, or using a domain name with bad-faith intent to profit from the goodwill of a trademark belonging to someone else. Especially in the earlier days of the Internet, when the big companies hadn’t already realised the future interest of the web, many trademark names were registered by individuals who intended to sell these names to the trademarks owners at a much higher price than they paid for the registration. But not only trademarks can be “cybersquatted” but also well-known people have been surprised when they saw that someone else registered a domain name containing their name (eg. www.[VIP's Name].com)

Domain Name Typosquatting

Typosquatting is changing a letter of well known domain names to attract traffic. For example, www.TRADEMERK.com instead of www.TRADEMARK.com.

The typical victims of typosquatting are mostly frequent visited sites. The typosquatter's URL will be similar to the victim site by using:

  • A common misspelling of the intended site
  • A misspelling based on typing errors
  • A differently phrased domain name
  • A different top-level domain
